Neil is a dedicated property litigator. He joined Kimbells in 2002, after nearly 8 years' experience in property litigation teams at 2 national law firms (Shoosmiths and then DLA) and a spell in-house, becoming a Partner in May 2005. Neil is a member of the Property Litigation Association.

Recent examples of work handled include:

  • Acting for several of the largest names in the UK leisure sector on the whole range of general estate management
  • Contested rent reviews, including achieving a saving of £300k p.a. for a client
  • Dilapidations claims, disputed lease renewals and Party Wall issues
    Boundary disputes, including a high value case in Mayfair
  • Seeking specific performance of a building contract in a multi-million pound dispute
  • High Court actions relating to unreasonable withholding of licence to assign by landlords
  • Successfully defeating High Court claim by landlord challenging Arbitrator's decision in high value rent review (Leftbank Properties Ltd -v- Spirit Group [2008] PLSCS 6)
  • Defending a multi-million pound claim for specific performance of tenant's repairing obligations
  • High Court action for specific performance of a purchaser's obligations to complete purchase of a property
  • Regular advice on insolvency issues affecting landlords and tenants.

Neil heads our property litigation team, working alongside Mark Brown and Rebecca Marment. The team is recognised in Legal 500 (2009 edition) as one of the strongest of any law firms in the South East. Neil is described as a "firm but fair litigator who is considered in his advice" and is praised for being "able to think outside the box" (2008 edition) and is "extremely knowledgeable" and "cost conscious" (2007 edition).
